This statement does not cover information collected from sources other than this site. If you have any questions about how we use information collected by means other than this site, you should inquire at or before the time you give such information to us.

Note that this policy contains several important exceptions, most notably the exception involving use of information to identify and/or pursue persons who are under criminal investigation or who damage, or may damage, our information or other resources. Please read the entire privacy policy to be sure that you understand these exceptions.

1. Information Ownership, Collection and Use

We are the sole owner of the information collected through this site. We will not sell, share, or rent this information to others in ways different from those disclosed in this policy. We may collect information from users at several different points on this site.

2. Types and Uses of Personal Information

Additionally, Ikonic, Inc.'s may automatically collect or process personally identifiable data, such as your Internet domain or IP address, as part of the operation of this site or during the course of your activities on or use of this site. In nearly all cases this data may be collected or processed by, and transferred to, Ikonic, Inc.'s facilities in the United States. By using this site (which resides in part on servers located in the United States), you unambiguously consent to any collection, processing, transfer or use of any personal data. 3. Ordering, Event Registration, and Related Processes

When and if you order products or services or register for an event using this site, we may request information from you using an order form. 4. Use of Cookies

Ikonic, Inc.'s may use "cookies" in connection with operation of this site. Cookies are small pieces of information that are stored on your computer by the Ikonic, Inc.'s web site server. Cookies are used for record-keeping purposes: the stored information can be retrieved by the Ikonic, Inc.'s web site server when you return to the web site. This allows Ikonic, Inc.'s to personalize or regulate the use of this site, and also permits Ikonic, Inc.'s to automate the access and data-entry functions of this site (e.g., login information), to store on-line ordering information for purchases you may make while visiting this site, and to tailor the appearance or presentation of this site to your preferences or interests. In general, we do not use cookies to track the navigational habits of identified users without the user's consent. If you visit this site only to read or download content, much of the information we do collect is statistical only (e.g., the domain from which you access the Internet, the date and time you access our site, and the Internet address of the web site from which you linked directly to this site) and not personally identifiable. We use this information about the number of visitors and their use of this site in aggregate form to make this site more useful and attractive to you.

The use of cookies is common in the industry, and they are used at most major web sites. Cookies will not be used to pass any information from your computer except the specific information placed into the cookie from one participating Ikonic, Inc.'s site when the cookie is retrieved by another participating Ikonic, Inc.'s site. You may wish to adjust your Web browser to inform you whenever a cookie is to be used, or to reject all cookies automatically. However, if you elect not to accept cookies, some parts of this site may not function properly or permit access. For more information on cookies, see http://www.cookiecentral.com/faq.htm. Ikonic, Inc.'s does not operate http://www.cookiecentral.com/faq.htm and we make no representation or warranty about the information contained in that website.

5. Log Files

We or our hosting provider may collect traffic information from visitors for statistical analysis and to improve this site. When you access this site, we or our hosting provider may collect information about your visit in a log file on a server. Log file information may include, but is not limited to, internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. We or our hosting provider use this information to analyze trends, administer this site, track users’ movements in the aggregate, and gather demographic information for aggregate use. IP addresses and other log file information are not linked to personally identifiable information. We and our hosting provider review this information to understand overall trends and to determine what kinds of content are popular and useful to users.

6. Sharing with Third Parties

(a) Aggregated Information. Ikonic, Inc.'s and its hosting providers may share aggregated demographic information with our users and other organizations with which we do, or contemplate doing, business. Such information is aggregated and is not linked to any information that can identify individual users.

(b) Outsourcing Providers. We may use outside shipping or other outsourcing providers to perform some functions such as packaging, sending and delivering purchases and information to you, clearing credit card transactions, performing statistical analyses of our services or performing sweepstake services and promotional services. We use commercially reasonable diligence to restrict the purposes for which these outsourcing providers may use your personally identifiable information. The requirements or requests that we impose on such outsourcing providers vary with the sensitivity of the information and can, but do not necessarily, include requirements that these outsourcing providers not retain, share, store, or use personally identifiable information for any secondary purposes, except for backup and recovery operations. Although we use good faith efforts to impose, and/or ensure compliance by our outsourcing providers, we cannot, and will not, be responsible to users for misuse of personally identifiable information by such outsourcing providers.

(c) Specific Services. We may have agreements with other parties to provide specific services. When you use such services, we may share personally identifiable information with such parties. In such cases, we will use good faith efforts to restrict the information provided to that which is necessary for the provision of such services.

(d) General Use. We share personally identifiable information, whether in return for compensation or otherwise, with various vendors, suppliers, and advertisers. While we use good faith efforts to verify that such vendors, suppliers, and advertisers promote products and services of interest to users of this site, we cannot, and do not, endorse such vendors, suppliers, advertisers, products or services unless we expressly state otherwise. We share only such information as you yourself provide to us or someone else provides about you (such as through a registration process) and do not share personally identifiable information derived indirectly through IP address tracing or similar means. If you wish us to refrain from providing your personally identifiable information in this manner, please see the Opt-Out and Contact Information sections below.

(e) Exceptions. Notwithstanding anything to the contrary in this privacy policy or elsewhere on this site, Ikonic, Inc.'s may disclose information when required by subpoena, search warrant, or other legal process, or in response to activities that are unlawful or a violation of Ikonic, Inc.'s rules for use of this site, or to protect and defend the rights or property of Ikonic, Inc.'s. Further, Ikonic, Inc.'s reserves the right to share any information you submit in connection with the sale, assignment, or other transfer of the business of this site and/or Ikonic, Inc.'s.

(f) No Representation or Warranty. This Section 7 is meant as a general description of our practices. It does not impose any duty upon us and it does not constitute a representation or warranty by us upon which you may rely.

7. Other Uses Of Information

(a) Updates and Notifications. Occasionally, Ikonic, Inc.'s may also use the information Ikonic, Inc.'s collects to notify you about important changes to the web site, new services and special offers Ikonic, Inc.'s thinks you might find valuable. Customers who do not wish to receive those mailings or materials (whether by e-mail or paper mail) or who believe they are receiving those mailings by mistake can contact Ikonic, Inc.'s (as described in the Opt-Out and Contact Information sections below) to request removal from the mailing list.

(b) Newsletter. If you wish to subscribe to a newsletter we offer or to a mailing list that we maintain, we will collect from you contact information necessary to send the newsletter or other information to you. This is usually limited to your e-mail address, but may also include other information.

(c) Tell-A-Friend. We may offer a referral service that allows you to inform your friends and other acquaintances about content on this site or forward information to them. If you chose to use such a referral service, we will collect the friend or acquaintance’s e-mail address and use it to send to the friend or acquaintance a one-time e-mail inviting the friend or acquaintance to visit this site or providing the information you requested. We store this contact information for the sole purpose of sending the e-mail notification. When you use such a service, you represent and warrant to us that you have an existing business or personal relationship with the friend or acquaintance sufficient to avoid liability under any law that applies to unsolicited e-mail. You will be the sender of any such e-mail and we will merely be a service provider facilitating your sending of the e-mail.

8. Supplementation of Information

We sometimes supplement the information we receive from you with other information we receive from third party sources, such as credit card issuers or clearinghouses.

9. Security

Ikonic, Inc.'s has implemented commercially reasonable technological and operational security processes to protect your personally identifiable information from loss, misuse, alteration, or unintentional destruction. While no security measure can guarantee against compromise, Ikonic, Inc.'s regularly reviews and updates its security measures in an effort to provide appropriate security for all information held by Ikonic, Inc.'s.

10. Misappropriation of Personal Information

For the purposes of any applicable law regarding notification of persons whose personal information was, or is reasonably believed to have been, acquired by an unauthorized person, our information security policy provides that any required notification may, where permitted by law, be made by the use of e-mail, telephone, fax, mail (including a notice printed in an available area of a bill or statement) or posting a notice on this site. The specific means used is up to us and we will use our judgment based on the circumstances. Where any notice is to be sent to a specific address or number (such as e-mail address, physical address, telephone number, etc.), we will use the latest available address in our records. EXCEPT TO THE EXTENT PROHIBITED BY LAW, YOU AGREE TO THIS MEANS OF NOTIFICATION.

11. Access and Accuracy

Ikonic, Inc.'s wants to maintain only accurate information about users of this site. You can request individual information that has been gathered about you by contacting Ikonic, Inc.'s. Upon receipt of appropriate identification information, Ikonic, Inc.'s will provide you with access to the personally identifiable information that it maintains about your use of this site or which you have supplied to Ikonic, Inc.'s via this site. If you find factual inaccuracies or your personal information, such as contact information changes, please notify Ikonic, Inc.'s so that they may be corrected.

12. Data Retention

Ikonic, Inc.'s will not retain your personal information longer than is necessary for the purpose it was collected.

13. Linked Web Sites

We may provide links to third party sites. Since we do not control these web sites, we encourage you to review the privacy statement posted on these (and all) third party sites. Ikonic, Inc.'s is not responsible for the privacy statements or practices of sites and services controlled by other companies or organizations.

14. Modifications

(a) Modification of Privacy Policy. Ikonic, Inc.'s reserves the right to change, modify, or update this Privacy Policy at any time without notice. We indicate the date of the current Privacy Policy below, so you know when it was last updated. Continued use of this site after any such revision or modification constitutes your acceptance of the Privacy Policy as so revised or modified.

(b) Modification of Use of Already Collected Information. We will use information in accordance with the privacy policy under which the information was collected. However, if we decide to use information about you in a manner different from that stated in the Privacy Policy in effect at the time of collection, we will notify you by e-mail if, and to the extent that, you have provided your e-mail address. If you reply to such an e-mail within a reasonable time and request that we not use your personally identifiable information in the proposed new manner, we will honor your request, but we reserve the right to suspend your access to all or part of the services offered through this site if you do so. If you do not reply to such an e-mail, or we receive a reply of “undeliverable” or similar message from your last known e-mail address, in either case after a reasonable time, we will use the information in the proposed new manner.

15. Children

It is Ikonic, Inc.'s’s policy to refrain from knowingly collecting or maintaining personally identifiable information relating to any person under the age of 18. If you are under the age of 18, please do not supply any personally identifiable information through this site. If you are under the age of 18 and have already provided personally identifiable information through this site, please have your parent or guardian contact us immediately using the information below so that we can remove such information from our files.

16. Opt-Out

If you no longer wish to receive newsletters or promotional materials or have your information provided to third parties, you may opt to not receive such communications or have information shared by contacting us as described in the Contact Information section below. We will comply with your request as soon as is commercially practicable. Our compliance may involve batch processing and other processes that take 30 days or longer. If you opt not to receive such communications or allow us to share your information and later give your personal information to us again using this site or under other circumstances that permit us to use your information, we will regard your opt-out as rescinded.

In most cases, it is impractical for any other party to whom we have supplied your information to stop using that information, so opting out will usually not stop others to whom we have provided your information from continuing to use it.

18. Response Times

We will use commercially reasonable efforts to timely make any changes you request. Many such changes are accomplished using batch processing (i.e. collecting a number of similar change requests and making all such changes at once), so the changes may not be immediately effective. If you require an immediate change to your personally identifiable information and are unable to make such a change using the available resources on this site, please contact us.
